I can't say I know everything there is to know regarding intellectual property law, but typically the courts feel that derivative products are necessary because they encourage competition. If the shoes were not presented as being genuine Sketchers and were not exactly identical then I don't think there is a whole lot that they can really do. But there might be some statutes I don't know about that might negate that.
