I developed a software application for a previous employer, they own the copyright. The application is not original, there are many competing products and they do not market it externally. The application was very simple and, in hindsight had some inherent limitations. I see a market for a more sophisticated version of the software, with source code completely rewritten so that it would be used on different platforms to my old firms. There would however be similarities with my old firm's version. It would do the same thing, look similar (although it looks like many other applications too). But none of the source code would be reused. Will I be in breach of their copyright ?
