: My high school had a great spirit song that was written in the 1930's. I would like to use the music and a slight variation of the words for the elementary school where I teach. We will sing and play it at school events - not for profit. Can we do this? I've contacted the principal and the band director at the high school and they said they didn't have a problem with us using it, but they didn't know about the legal/copywrite issues. Do we have to have anything other than permission from these two gentlemen in order to teach it to our children (grades preschool-8th grade)?

Dear Lilian,
Copyright infringement, includes, copying and can include performing. I'm not sure if what you suggest is a fair use. If there was a broadcast performance that could be a danger. If in fact what you do is infringement, a judge would be very irked be be burdened with any action even if it were an infringment unless where was wide use and money involved.

I would expect, without taking legal responsibility, that if there were a problem that you would be given a warning first and given an opportunity to stop.
