The third party present owner of the copyright in the work is negotiating a deal involving the use of the work in a film to be released after the copyright has reverted to the original copyright owner. I suspect that there is a clear answer to this one. I'm not going to do the research. My hunch is that if the deal is legitimate when consumated that the assignee may be home free. That answer doesn't sit right with me but I have a feeling I have seen cases to that effect.
