: : : OK two hypothetical senarios here:

: : : 1. A person has photographs taken of them by a photographer working on behalf of Playboy Magazine. Who retains the copyright. Playboy, the photographer?

: : : 2. A person submits a photograph that had been taken by someone else who was not affiliated with Playboy. It most likely was not taken by a professional photographer. Does the individual relinquish his/her right to the image to Playboy?

: : Dear Steve,
: : 1. Can depend on prior written agreements.

: : 2. There are at least two sets of rights here.

: Why doesen't M. Aurther expand on questions asked?
: we all come on here to aks questions to have them answeared in full, not partially answeared. PS, just out of curiousity, what would you say makes a professional photographer a professional? Is it A) recieving payment for his/her photography services? B) His/Her owning a photography, licensed business? Or D) all of the above?

Dear Tim,
You support yourself somehow. Well I support myself by practicing IP law. I don't mind being helpful but I couldn't afford to spend my time answering questions id I did not have a income to keep me in businesss.
