If content was able to be copywrighted, then you would never see two different artists painting the American Flag on any surfaces, no matter how similar. Now, if I was to download and print out someone's copywrighted design, then cut it out and decoupage or paste it onto something, then sell it as my own work...that would definitely be infringement. But, to take that design and paint one structured like it and containing the same elements, that is not infringement, because even though I am doing the same thing, it is completely impossible to get anything EXACTLY the same when doing freehand painting.
