Ideas are not protected by copyright. Derivative works are very specific. They have a basic subtance that is use and varied. The basic mode of expression is included in the work. If you start with an idea and use the idea, and create your own mode of expression, then there is no infringment. What you create, even a derivative is likely registerable as a copyright.The derivative work is subject to the copyright on the basic work. If in doubt give me a call.
