Sole-source or sole-provider Internet databases: intellectual property or anti-trust issue?[ Follow Ups ] [ Post Followup ] [ Copyright Forum ] [ FAQ ] Posted by Frank Black on August 28, 1999 at 13:38:34: How important is the sole-source distinction between Internet database owners with real competition and database owners who have effective sole-source distribution of a kind of information? Have the courts made *any* distinction regarding public or for-profit re-use of sole-source information? Is this a copyright or anti-trust issue? In other words, has any sole-source Internet company or non-profit had claims of copyright violations rejected based on anti-trust codes, or is this not possible? I've been searching for days for this information, and all I've got so far is an HR passed in March that hasn't been advanced by the Senate. It addresses the sole-source issue in very vague language, and it seems as though this legislation would leave the sole-source issue essentially in the hands of common law rulings.
