I've been onto such sites as bandname.com, where it appears that more than one person can register the same name. This then leads to the question of what happens when one band begins to become successful using that name, and then after a while John Doe in Sleepyville, TX (no offence, Texans) comes along and claims, "That's the name of *my* band." : Therefore, what I am trying to ascertain is how I go about registering the name to prevent anybody else *anywhere* using the same name, if such a thing exists. : Any help would be greatly appreciated. : Kind regards, : Steve Bell, London, UK Dear Steve, You should register the service mark, the name of the band, in the UK. Applying will give you six month treaty priority on the mark in the major countries of the world. We can recommend counsel to you. Don't screw around and try to save a few bucks (pounds). One of our service marks is Elaine's Workshop. Early Legal Advice Is Not Expensive. You don't do it right now it will cost a fortune when you are popular and not properly covered or worse still you have a conflicting name. M.
