I have a situation in my rock band where a group member was kicked out because he was inadequate at the guitar, but before he was kicked out, he played a small (30sec.) guitar part on one song on a compact disc recording that was mastered and will be sold. He did not write the part that he played, and he was credited with playing on the track in the CD liner notes. He is no longer associated with the band but we do plan on playing that song live with a different guitar part in place of the one he recorded. Any help on whether he is able to collect royalties or whether we should pay him either for playing the part (work for hire, although at the time he was a General Partner in the "business" and according to the UPA need not be remunated) or for the rights to the song. Any answers or references to current resources would be greatly appreciated.
