Under the Copyright law, any original expressive materials which you have created and fixed (recorded) can be protected.

General types of materials that are eligible for copyright include: paintings, sculpture,
drawings, photos and other artwork; novels, books, plays, poetry, software and musical compositions, and other writings, sound recordings and other creative expression.

To be copyrighted, your songs must first be fixed(completed) AND RECORDED (written, audiotaped, videotaped etc.). Then they should be registered for protection by filing an application for Copyright protection with the US government Library of Congress.

Written by and for lawyers, Copyright Application forms can be difficult and confusing; worst still the proper form depends on the nature of the work. There are differnet forms for Visual Artworks, Sound Recordings, Literary Materials, Performing Arts, Serials, etc.).

Musical works can be registered as SOUND RECORDINGS (which protects the recording itself) or as compositions within the PERFORMING ARTS category (which protects the words and music on paper).

Government Filing fees are presently $30 per application. OR

For $249 including government Filing
Fees, our attorneys will: prepare the application forms for up to two authors or contributors; and file the application and deposit material with the United States Register of Copyrights; notify the client of official correspondence, periodic legal advice, consultation and reporting regarding the application; and send the client the Copyright Registration certificate.

With very few exceptions (for bulky or irregularly shaped items) all postage and copies are included at no extra charge.

It usually takes from three to six months from the filing date to receive the registration certificate.

-AUTHOR'S NATIONALITY AND DOMICILE

-WHETHER THE AUTHOR'S CONTRIBUTION TO THE MATERIAL WAS A "WORK FOR HIRE"

(generally speaking, the person who creates the work is the author - however, an
exception is made for A WORK FOR HIRE (when the author as an employee creates the
work within the course and scope of his or her employment; or when a third party
(non-employee) is specially ordered or commissioned to create the work and has waived
his rights of authorship in writing.

-WHETHER THE AUTHOR'S CONTRIBUTION WAS ANONYMOUS OR PSEDONYMOUS?

-NATURE OF AUTHORSHIP ( e.g., 3-D sculpture, 2-D artwork, map, photograph, text,
technical drawing, jewelry design, architectural work, sound recording, audio-visual
material, etc.)

(For certain items, additional information will be required (e.g., for audio-visual material a program description must accompany the deposit material).

- YEAR IN WHICH WORK WAS CREATED (COMPLETED)

- DATE AND NATION OF FIRST PUBLICATION

- NAME OF COPYRIGHT OWNER (CLAIMANT)

(IF DIFFERENT FROM THE AUTHOR - PLEASE INDICATE HOW THE CLAIMANT OBTAINED OWNERSHIP
OF THE COPYRIGHT (E.G., BY ASSIGNMENT OR TRANSFER)

- (derivative work or compilation) WHETHER THERE IS ANY PRE-EXISTING MATERIAL CONTAINED
IN THE WORK OR IF THE WORK IS BASED ON OR INCORPORATES OTHER MATERIAL

ULTIMATELY THE APPLICATION MUST BE SIGNED BY THE COPYRIGHT CLAIMANT OR A POWER OF
ATTORNEY MUST BE OBTAINED WHICH WOULD AUTHORIZE THIS FIRM TO EXECUTE THE APPLICATION
ON THE CLAIMANT'S BEHALF.

- DEPOSIT MATERIAL - FOR PUBLISHED WORK WE WILL NEED 3 COPIES OF THE MATERIAL; FOR
UNPUBLISHED WORK WE WILL NEED 2 COPIES.
