We make short films and post them on the internet for free. My question is... We are designing a logo for our group and found a picture of a wrestler . We would love to incorperate his picture as our icon for our group. My best guess is that the picture was taken in the mid 50's. I have seen the picture on afew sites and have e-mailed them to find out if they had any info on the photograher or anyone who I could talk to gain permission to use it. But nobody has ever replied. So, what can I do? There is no text on the picture to give me a clue. I do know that the wrestler died in 1998 at 70 years old and is from Canada. Thanks Dear Pixar, I don't believe in being cowardly but when it comes to the law if you screw up early it costs through the nose to get out of trouble. There are a mixture of IP rights here. The right of the individual or the estate's rights to the image and the right of the photographer, which is separate. You may never be challenged but if you are it can cost. This is the type of actual situation that can happen. A photographer customer of a restaurant was asked and paid to take pictures of the restaurant. The the restaurant, took one of the pictures, it had paid for and painted it outside the restaurant. They were sued by the photographer for copyright infringement. M.
