Without research, if I represented the owner of a scanned image, I would check the source of the image and certainly if the image was own or created by the owner and there was a copyright notice on the web page and the copyright were registered I might go after you. In any event I'd ask you to stop if the copyright were not registered and I wanted to go after you. Thinking about it the chances are that you would get a warning at least but you can't count on that.
