Publishing an Index

There is I believe a fairly well known precedent* that
holds that one can publish an index to anothers,
copyrighted work. What is not clear to me is whether
this can apply to the content creators index or only
to one created by the second party.

If the latter is the case then what evidence would
prove or disprove who authored an index. Are we
talking Rand McNally defense ? Something else ?
This is not a theoretical case btw. I saw it happen
recently.
