In a similar case where one news service linked to its competitor's news reports without disclosing that the information was written by such competitor was deemed as copyright infringement -- even though the competitor does not charge for the news reports, the court reasoned that the practice of deep linking (where the first page of the site or counter page is not directly linked to, but rather the page within the site concerning the relevant news story is linked). . constituted infringement by denying the news writer the "click credit" for, and the trademark ownership of the story.
