That is, if the music (lyrics and notes) is written down as a composition and/or recorded as a sound recording, copyright protection can be sought via application to the U.S. Copyright Office - Library of Congress. If a musician thinks of a new song and performs it to an audience, before writing it down or recording it, copyright does not protect the song, because it is not "fixed".
