The law is a wild west show at this point. The photographer, unless there is a writing to the contrary owns the artistic rights. Copyrights exist on the creation of the work. No action can be brought until a copyright has been registered. Without a proper copyright notice on the work the infringer must be given actual notice. M. Arthur Auslander
