: My wife along, with other ladies, is putting on a local Synchronized Swimming show and admission of three dollars will be charged. Music from a variety of artists will be played during the performance. Dear Mr. Cervini, Disavowing any professional responsibility for this answer and without any researh: People do this all the time. ASCAP, BMI, SECAC, and maybe THE HARRY FOX agency are out there to find who does and make them pay. Without taking professional responsibility, and I'm not sure without research, Playing of records from earlier than 1978 might be legit if the music was from before 1923. You might not get caught. If you hired a band, I it might be their responsibily to sign up so that they might be the ones liable if there were a question. I think taping off a VCR may be an infringement. I am not aware of any case where a homeowner has been sued. Selling the tape, is another thing. I feel guilty giving you my feel of the raw law. its like saying don't shut your eyes if you are crossing aginst the light. M. Arthur Auslander
