Software that can't be copied/backed up

I have purchased a piece of software in CD format
that can't be copied or backed up with any standard
CD writer program. It is protected by a 3rd party CD
protection scheme. It may be possible to circumvent
this copy protection by the use of a rather esoteric
copying program. (not a commonplace item).

I believe that the right to make a backup for archival
purposes has been well established. If this is
incorrect then please correct me.

The question is this; Has the publisher abrogated
my rights to a backup by making the CD such that
it can not be copied ? Is he obligated to publish
in such a way that backups can be made ? Or is the
ability to create a backup more a privilege than
a right ?
