You need to get an attorney RIGHT NOW in order
to pursue any civil claims against this person.
Also, if your copyright is not registered with the
U.S. Copyright Office, you will need to do so
before initiating a lawsuit. I wouldn't count
on the D.A. pursuing a criminal prosecution -- it
will be up to you to file a civil suit. Keep in
mind that there is a 3 year statute of limitations
for you to file a civil suit, which began at the
time of infringement of your copyright.
