: : : After much research through the US Copyright web site, : : : I still have some questions as to who, if anyone, holds : : : the copyright on a sermon or inspirational speech. : : : It is logical to think that the speaker would have the : : : copyright; however, most churches record the sermon and : : : resell copies of cassettes without affixing a copyright : : : notice. The speaker may not even know he was recorded. : : : Would the sermon or speech be covered as a sound recording : : : with the speaker retaining copyright, sound recording : : : with the church or organization retaining copyright, or : : : as a work commissioned by an employer (since the church : : : or organization requested and most likely paid the speaker)? : : : If the recording is subsequently transcribed, does the : : : speaker have the copyright to the written material? : : : Also, what if the recordings are old enough that any : : : copyright would have since expired? Is it then public : : : domain? : : : Any thoughts or input is appreciated. : : Dear Darnelle Hillman, : : Without research, you may be stirring a bee hive. I think the speaker owns thre rights. There are questions of fair use but my gut say that doesn't change things. : : M. Even public domain can be accumulated and copyrighted. You then have to be careful. If there is a copyright notice in a work that you are using, that is a big warning. Much may be available but you have to know ehat you are doing to be safe. M.
