: What do I do here. We are a Michigan band who are ready to release our first CD. The name is in use by a New York band that broke up over two years ago, however, the small record company that they were on still sells their records. The trademark office lists their servicemark as dead. : We already have a big following under our current name, and would love not to switch it. : Can we keep it?(please say 'yes'!!) : I know saying 'switch it before u manufacture your CD' is the easy way out. But it's not that easy. So many people know us by this name, and all of our promo material has this name on it, including our website domain. : Thanks in advance, : Tom
