Dear Kevin, It appears as if he may have violated a fiduciary duty to the company getting the information while employed. It looks like an act of unfair competition. He may be enjoingable. he may be liable for punitive damages. I am responding thinking in terms of US law a practice. In the US he might be handled harshly in view of the way he acted and might be liable for actual damages which might be trebled and your attorney's fees. M. Arthur Auslander
