The name is a single common word. They have produced a CD which will be published and start touring (possibly nationally). : One of the members is concerned that there is a magazine copywrighted with the same name. Should the band select another name? Should (or could) we get a Service Mark on the name currently being used? : Thank you for your assistance, Dear Ms. Foster, The facts must be gone over in detail. On the basis of what you say there is a good chance that the mark may be able to be registered. There is a new antidilution statute that may impact on the situation. The band needs competant Intellectual Property legal advice, that they can trust. M. Arthur Auslander
