Copywrited Name Use in Another Industy

Dear Mr. Auslander:

A local band has a name they have been using for about five years. The name is a single common word. They have produced a CD which will be published and start touring (possibly nationally).

One of the members is concerned that there is a magazine copywrighted with the same name. Should the band select another name? Should (or could) we get a Service Mark on the name currently being used?
