How can they do this?

Recently some websites have begun selling individual old magazine articles for a couple dollars per download. Some of the magazines in question only pay for First North American Serial rights when they buy the articles. How is it that these websites can claim to have gotten the right to sell the articles in an archive, when the copyright should have reverted back to the individual writer? Apparently contacting them does not make them remove the content -- they claim to own it. I am totally confused. Is there something the writers can do?
