The proper proceedure for a trademark is to apply to the Patent and Trademark Offics. It is advisable to know whether or not the mark is registerable and is if it conflicts with other marks. Even if the papers can be filed it takes legal know how to protect the user and to get a registration of value. A trade name may also conflict with someone else's trademark. Tradenames may also serve a trademarks. It is possible that you can do it yourself. we use the Service mark ELAINE'S Workshop because even if you can get an end result yourself, if there are legal problems down the line they can be VERY expensive and painful after the fact.
